Terms of Use — PGMNT

PGMNT ("the app", "we", "us") is a miniature-painting log that lets you record projects, models, painting sessions, paint records, and photos, and sync them across your devices. These Terms of Use ("Terms") govern your use of PGMNT. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use PGMNT. Please also read our Privacy Policy, which explains how we handle your data.

Who can use PGMNT

PGMNT is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us their information, contact us at privacy@pgmnt.app. You are responsible for complying with any age or other requirements that apply to you where you live.

Your account

You can sign in with your email, with Google, or with Apple. You are responsible for keeping your account secure and for activity that happens under it. Let us know at privacy@pgmnt.app if you notice unauthorized use. You can permanently delete your account and all associated data at any time from Settings → Account → Delete Account.

The service

PGMNT lets you record and revisit your miniature-painting work and sync it across your devices. The app is currently free to use. We may add, change, or remove features, and we may set reasonable limits (for example, on storage or the number of photos) to keep the service running well. We aim to keep PGMNT available and reliable, but we do not guarantee that it will be uninterrupted or error-free.

Because your projects, photos, sessions, and paint records may build up into a meaningful long-term record, we take discontinuation seriously. If we ever discontinue PGMNT, or discontinue a part of it that holds your content, we will make reasonable efforts to: give you advance notice where reasonably possible; give you a reasonable opportunity to export your content before it becomes unavailable; and avoid deleting your content without a practical chance to retrieve it first. This is a commitment to act reasonably — not a promise of uninterrupted service, permanent storage, or any specific notice period. These efforts may not be possible where prevented by legal, security, fraud-prevention, technical-failure, or operational constraints (for example, an unexpected shutdown of a service we depend on).

Your content

Anything you create in PGMNT — your projects, models, sessions, notes, paint records, and photos ("Your Content") — belongs to you. You keep all ownership rights in it. You grant us a limited, non-exclusive license to store, copy, sync, back up, and display Your Content solely to operate the app for you and provide the features you use (for example, syncing your photos across your devices). This license exists only so we can run the service, and it ends when you delete the content or your account. You are responsible for Your Content and for making sure you have the rights to it. We recommend keeping your own copies of anything important; you can export your data from the app at any time.

Acceptable use

Please use PGMNT lawfully and respectfully. You agree not to:

• store or share content that is illegal or that infringes someone else's rights;
• attempt to access other users' accounts or data, or break, overload, or interfere with the app or the systems that run it;
• reverse-engineer, resell, or otherwise misuse the app, except where the law expressly allows it;
• upload malware or use the app to violate anyone's privacy or rights.

We may suspend or limit access that violates these Terms or puts the service or other users at risk.

Our intellectual property

PGMNT — including the app, its design, the "PGMNT" name and branding, and the built-in paint catalog and other reference data — is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not give you any rights to our branding or content except to use the app as intended. Brand names and trademarks belong to their respective owners. Catalog information is provided for reference only.

Third-party services

PGMNT relies on third-party providers to work — including Supabase (hosting, database, storage, and authentication) and Sign in with Google / Sign in with Apple. Your use of those sign-in options is also subject to those providers' own terms. We are not responsible for third-party services, though we select them to operate the app as described in our Privacy Policy.

Disclaimers

PGMNT is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, secure, or error-free, or that your data will always be preserved. You are responsible for keeping your own copies of important content.

Limitation of liability

To the fullest extent permitted by law, PGMNT and the people behind it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the app. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

Termination

You can stop using PGMNT at any time and can delete your account and data from Settings → Account → Delete Account. We may suspend or end your access if you materially violate these Terms or use the app in a way that harms the service or other users. Sections that by their nature should survive termination — such as content ownership, disclaimers, and limitation of liability — will continue to apply.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, note the change in the app. Your continued use of PGMNT after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of Japan, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the app will be handled in the courts of Tokyo, Japan, except where applicable law gives you the right to bring a claim elsewhere.
